The smokers mecca is O'Malleys...I know smokers who won't go in there because it's too smoky, it's like something out of the 1950s.

I was thinking about posting a smoking ban thread. The Post had an article on it a few weeks ago and mentioned that not a single bar in the city had applied for a smoking ban exemption. That may have changed at this point but I've asked around at the bars I frequent and none of them will allow smoking after 1/2/11.

From what I understand any bar where food accounts for less than 25% of total sales can still allow smoking is this correct?

If that is the case pretty much any bar where the food menu consists of TJ's pizzas will likely still be smoky in Jan.

Bars that are 2,000 square feet or less, excluding the kitchen area, storage area and bathrooms, and whose food sales comprise less than 25 percent of the bar's gross revenue -- i.e. "incidental" food sales -- qualify for an exemption from the law. This is strictly a place for drinkin' and smokin', y'all!

I get it. I already know about the regulations of the ban. I am specifically looking for bars that definitively allow smoking after Jan 2nd.

They also sometimes lock the door, and you have to be let in. Is that even a real bar? Sometimes I think it's a firefighters living room - obviously the smoking ban doesnt impact that.

So you are telling me the South City dive bars I love to frequent are going to be more smokey than before. These establishments will attract smokers that would have stayed at the places they ate dinner at, but now have to find refuge in the corner bars that allow smoking!?! You thought dives were smokey before the ban!

^ Good thing. Your eyes burn the next day and you cough up junk from spending even a few hours at those places, if you are not a smoker or used to being around smokey places. They are fun places to have a few, but the secondhand smoke is just unbearable.
I can't wait until a complete, hardline ban is in place everywhere. I have smoked WAY too many secondhand cigs.

^You can go to any South City corner bar that does not get more than 25% of it's revenue from food. In other words, you can still drink at 'drinking pubs', unfortunately.

Another Smokey bar that I like is 'The Bleeding Deacon'. That place is bad even with the door open. Great food though! Not sure how much revenue they get from food, but hopefully it is more than 25%.

Tents to count as "enclosed space" for smoking ban exemptions
KWMU, 90.7 FM

ST. LOUIS (St. Louis Public Radio) - Bars in St. Louis that use tents to expand their seating area will have to include that space as they determine if they may be exempt from the city's smoking ban.

The Joint Board on Health and Hospitals on Thursday agreed with the health department's interpretation that tents should be considered enclosed spaces.

"If you have the potential to roll down the sides, it should be considered enclosed," said board member Will Ross, an associate dean at the Washington University School of Medicine.

I think the big question that remains is the one of enforcement. Who is going to do it, and how can bars be held accountable? I'm skeptical to say the least. The next few weeks will be interesting to see how things begin to pan out. I didn't realize that bars that think they are exempt actually have to apply for a certificate of exemption. I wonder if they even know that? I think it's a good thing, but it all just seems a bit overly confusing. It will be interesting to see if anyone applies for an is actually denied an exemption.
