They're not prohibited, same as any other property owner in a historic/review district, as long as they have an approved redevelopment plan or other acceptable reason according to the PRO/PRB.
According to the SLBJ, they’re considered ‘buildings of merit’ by the PB. As Tim said, there has to be a redevelopment plan.

Wonder if a February start date is still in the cards...A St. Louis board on Thursday has approved a deal in which a hotel developer will pay the city $750,000 if the company backs out of building two hotels on the former Wells Fargo campus in Midtown. Maryland Heights-based hotelier Midas will make the deposit when it applies for the permit to demolish the buildings at 2601 Market Street. If Midas pursues the project, the deposit will apply to the cost of the building permit for the two hotels.

Midas said it had not finished the design and wasn't ready to apply for a building permit — but it had to proceed with demolition or it would face millions of dollars of added costs, including a $1 million penalty from the hotel franchise if Midas didn't start the project by February.

^Weren't they just denied a demo permit? Or maybe that was just the recommendation and they got it in the end anyway.
No, demo permits were contingent on a building permit. They said they couldn't wait that long so worked out this posting bond deal as an alternative.

Its confusing what was approved, i think what the developer did was basically pre pay for its building permit, so if the permit is issued this $750,000 pays for it but there is nothing in place for the City to get if the project gets called off after the permit is issued, which has happened before. Now i doubt the project isnt moving forward but this has been delayed for a month for basically no reason now.
The goal was a substitute for the contingency of a building permit before demo. Can/should they go beyond that to avoid the situation you describe?

I dont know if the city could have legally but i dont think it was even a necessity, this isn't some shady developer that was just looking to demo buildings.

I suspect, but can't confirm that any necessary abatement work has already been completed. Spirtas has been doing work in the buildings for some time now. Well before the demolition permit was issued. The one thing the City does check for before issuing a demolition permit is asbestos. There are a couple inspectors with the Health Department for that.

Sad to see the building go, I was quite a fan of it architecturally, but at least one half will still remain. As for the new buildings, I do admittedly quite like the kimpton and am excited to see it rise, the staybridge is very meh architecturally. Would have loved to see them convert the existing building into the staybridge and build the kimpton in the corner of the site of the replacing the garage, we all know that that wouldn't happen.

If all continues to go as planned, demolition would completely wrap by Oct. 1, and construction of the hotels could start in early 2024 after site preparation, Eigelberger said.

Each hotel will have its own 6 story tower and the buildings will be connected by first floor amenities and back of house area and an underground parking garage. [In] total there will be over 300 guest rooms, two restaurants, a lobby bar, ballroom, fitness centers, lounge and buffet. [Total project is] over 270,000 sqft.
