It sounds as if their whole argument, after this case was not taken up by the Supreme Court, is that this is an "opportune case" for the courts to resolve a conflict they say exists among lower courts.

"In reality, courts and commentators have long recognized the confusion surrounding the interplay between the FAA’s equal-footing principle and the “clear and unmistakable” test. This is an opportune case to dispel that confusion once and for all, and to make clear that there is no arbitrability exception to the equal-footing principle."

Is "arbitrability" a word?  

I like this title of Section 1. "Courts Are Divided Over The Import Of This Court’s “Clear And Unmistakable” Test For Assigning Questions Of Arbitrability To Arbitrators."

Some of their argument sounds kind of snarky.  And if there is some big "opportunity" for the courts to straighten out a conflict that the lawyers say the courts have created, why would the SC see this case as so representative, and so broad, that it should be the case that resolves anything.  I would think the courts would just see this as a lame attempt to get a previous unfavorable ruling overturned.  I'm not sure the court will even agree that there is some massive conflict involving arbitration or not that needs resolving.

I'm no lawyer either, but if I'm understanding what is going on here, I think this will fail again for Kroenke and the NFL.

Pretrial is September 24th, 2021, trial is October 25th, 2021.

2021? What happened to justice delayed is justice denied? The courts need a shot clock. I’m guessing we’ll get a lot of “don’t recall” from Eric Grubman.

Cases with these dollar figures attached to them frequently take years to wind their way through the legal system. Sometimes decades.

The NFL is trying to delay the production of documents - particularly communications by and between team owners. So, having a 2021 date (or ever later)  actually makes sense for the plaintiff's who would need time to collect and analyze thousands of emails, phone records, etc... and submit follow up requests based on their initial findings, once/if the NFL's delay tactics run their course.

Can anyone give more detail about what this means? From my understanding, "relisted" is not great for us. Doesn't this mean the SC is watching closely and could determine Friday to take the case?

When a case is “relisted,” that means that it is set for reconsideration at the Justices’ next Conference.  Unlike a hold, this will show up on the case’s electronic docket.  A relist can mean several things, including the fairly straightforward prospect that one or more Justices wants to take a closer look at the case; that one or more Justices is trying to pick up enough votes to grant review (four are needed); that the Justices are writing a summary reversal (that is, a decision that the lower court opinion was so wrong that the Court can decide the case on the merits without briefing or oral argument); or that one or more Justices are writing a dissent from the decision to deny review.

One of the most damning pieces of evidence against the Rams is Jeff Fischer saying when he was interviewing or shortly after
being hired he was shown the plans for the stadium in LA.  That was a few years before they left.
The Rams and the league know the STL lawyers have them by the family jewels.   There are a lot of interviews by Demoff and
others that show the Rams had no intention of negotiating in good faith.  I heard a lot of them myself on 101.1 with Demoff.

I think that we'll see a settlement of over $1B, possibly closer to $2B, paid out over 20+ years.   Now that Kroenke and the NFL are out of options and discovery will be ramping up, they're going to need to shut this down quickly or risk exposing all of the skeletons in their closet.

Could you imagine if emails or records are discovered where owners admit to swindling their home cities for unnecessary TIF or stadium incentive money?  Seriously, all it would take is for one owner to have sent an email that says "Do we really need $X in public support to build this stadium?  Nope.  Will we take the free money?  Absolutely"  San Diego and Oakland certainly will now want to do similar lawsuits and keep them in state court.

Lester Munson believes that both the Region and Kroenke will work towards a settlement. He suggest the right number could be around $200m. Seems low to me.

If, after all of this, they settle for $200 million and nothing else, I'll be really PO'ed.  Other sources have stated Team Blitz is looking for an amount closer to the relocation fee Kroenke had to pay. This amount seems more reasonable.

It makes my heart sing to see the situation Stan Kroenke is in right now:
  • Goes way over budget on his stadium, spending >$5 billion
  • NFL season could potentially end up cancelled, losing him a boatload of TV $$$
  • STL City balances its checkbooks with a perfectly timed $200+ million infusion right out of Kroenke's pocket.
  • Rams look like they are going to suck this season and have a stupid new logo

city of St. Louis into their coffers. Hopefully it is a billion plus, So maybe the city sees a few hundred million dollars.
